These Terms govern the relationship between you and BookiePrice Pty Ltd (ABN 89 652 379 916, ACN 652 379 916), the operator of BookiePrice and the website https://bookiepnice.com/ (the "Service"). By opening an account, by accessing the Service, or by placing a bet, you agree to these Terms and to our Privacy Policy, our Cookie Policy, our Responsible Gambling charter, and our AML/CTF program statement.
1. About these terms
These Terms apply to wagering services provided by BookiePrice Pty Ltd under Sports Bookmaker Licence No. 3207/2022/WB issued by Liquor & Gaming NSW. They form a legally binding agreement between you and us, and govern your use of the Service whether accessed by web browser, mobile site, or any application made available by us. Where a market or promotion has additional specific rules, those rules apply in addition to these Terms and, in the event of inconsistency on the specific point, the specific market or promotion rules control. We may make additional information available from time to time, including market rules, settlement rules, and dispute-resolution information. That additional information is incorporated by reference into these Terms.
These Terms are written in English. We may make translations available for convenience only. The English version is the controlling version. Headings are for ease of reference and do not affect interpretation. References to legislation include any successor or replacement legislation. References to a regulator include any successor regulator.
2. Definitions
In these Terms:
- "Account" means a customer account opened with BookiePrice.
- "AML/CTF Act" means the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
- "Australian Consumer Law" means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- "BetStop" means the National Self-Exclusion Register established under the National Self-Exclusion Register (Cost Recovery Levy) Act 2019 (Cth), administered by the Australian Communications and Media Authority.
- "Business day" means a day other than a Saturday, Sunday or public holiday in New South Wales.
- "Customer", "you", "your" mean a person who has applied for, opened or operates an Account.
- "IGA" means the Interactive Gambling Act 2001 (Cth).
- "NCPF" means the National Consumer Protection Framework for Online Wagering.
- "Privacy Act" means the Privacy Act 1988 (Cth).
- "Service" has the meaning given in the introduction to these Terms.
- "We", "us", "our" mean BookiePrice Pty Ltd.
3. Eligibility
To open or operate an Account, you must:
- be aged 18 or over;
- be ordinarily resident in Australia and physically present in Australia when you access the Service;
- provide accurate personal information and successfully complete identity verification;
- not be self-excluded under BetStop or under any operator-level self-exclusion with us or any other licensed Australian online wagering operator;
- not be an employee, director, contractor or close associate of BookiePrice Pty Ltd or its related bodies, nor a person prohibited from wagering under any Australian law or sports integrity rule;
- not be the subject of any court order, undertaking or regulatory prohibition preventing you from wagering or from holding a wagering account; and
- not access the Service from a country designated under section 9A of the Interactive Gambling Act 2001 (Cth).
You must not allow any other person to access or use your Account. The Account is personal to you. You are responsible for all activity that occurs on your Account, subject to consumer guarantees under the Australian Consumer Law and any rights you have if your Account has been used without your authority and you have not contributed to that unauthorised use.
4. Account opening and identity verification
Identity verification is conducted at account opening in accordance with the AML/CTF Act and the Anti-Money Laundering and Counter-Terrorism Financing Rules made under that Act. We will generally require at least one government-issued photographic identification document (driver's licence, passport, or other accepted document) and confirmation of your residential address. We may also use electronic verification through one or more identity verification service providers.
We may request additional information or documents at any time, including where risk indicators are present, where a transaction triggers enhanced due diligence under our AML/CTF program, where payment or fraud checks require further confirmation, or where a regulator, payment processor or financial institution requires it. We may suspend Account activity, deposits, withdrawals or bet placement while we complete additional checks.
If we cannot verify your identity to the standard required by law and by our AML/CTF program, we may decline to open the Account or, where the Account has been opened, we may close it. Any cleared balance will be returned to you in accordance with section 13 (Account closure).
5. Customer obligations
You must keep your contact details, residential address and other personal information up to date. You must keep your login credentials confidential and not share them with any other person. You must notify us immediately if you suspect that your Account has been accessed without your authority by contacting support@bookiepnice.com or 1800 266 543.
You must not use the Service to engage in fraud, collusion, match-fixing or other integrity offences, to launder the proceeds of crime, to finance terrorism, or for any other unlawful purpose. You must not attempt to circumvent any limit, exclusion, restriction or other control that we have applied to your Account. You must not use software, scripts, bots or other automated tools to interact with the Service in a way that interferes with normal operation or that gives an unfair advantage.
6. Deposits
We accept eligible debit card payments, BPay, PayID, Apple Pay and Google Pay where linked to an eligible debit card. We do not accept cryptocurrency, credit-card transactions on consumer credit (in line with the Interactive Gambling Amendment (Credit and Other Measures) Act 2023 (Cth) and the National Consumer Credit Protection Amendment (Banning Credit Card Use For Online Gambling) Act 2023), or third-party payments. Card surcharges, if any, are disclosed at deposit.
The minimum deposit is $5. The default maximum single deposit is $5,000. We may apply a lower limit if you have set a lower personal deposit limit, or for responsible gambling, risk, payment or compliance reasons. Where you have not set a personal limit, the default operator maximum is an operational ceiling and is separate from a personal deposit limit. We may refuse or reverse any deposit, with reasons provided where practicable, where required for risk, compliance, payment integrity, regulator request, or where we reasonably suspect a breach of these Terms.
7. Withdrawals
Withdrawals are paid to a verified account in your name. Withdrawals are processed subject to account verification, payment checks, AML/CTF checks and business-day processing times. Card refunds can take 3 to 5 business days depending on your bank. We do not charge withdrawal fees. If a withdrawal cannot be completed to the requested method, we will contact you to arrange an alternative verified method.
We may delay or decline a withdrawal where it is necessary to complete identity verification or AML/CTF checks, where we reasonably suspect fraud, collusion, integrity breach or other unlawful activity, where a regulator, payment processor or financial institution requires it, or where the funds are subject to a pending review of a bet, market or promotion. Where a withdrawal is delayed, we will keep you informed by email or in-product message.
8. Bet acceptance
A bet is only accepted when we have confirmed acceptance to you. The price displayed at the time you confirm the bet is the price applied, except where a palpable pricing error has occurred (see section 9). We may refuse, void or limit any bet where required for risk, compliance, integrity, regulator request, or where we reasonably suspect a breach of these Terms.
Markets close at the scheduled start time of the event unless otherwise stated. Under the IGA, live in-play betting on sport is not offered online to Australian customers. Pre-event markets close at the scheduled start time. Where a bet is accepted in error after the scheduled start time, the bet may be voided.
9. Void bets and palpable error
A palpable error is a manifest mistake in the price, line, total, runner, market or selection offered, including pricing that is materially different from the prevailing market price, pricing on a non-runner or scratched runner, pricing on the wrong event or selection, or pricing affected by a technical defect in our systems or in a feed provided by a third party. Where a palpable error is identified, we may void affected bets and return the stake.
Bets may also be voided where the event is abandoned and not rescheduled within the published window, where the result cannot be determined under the rules of the relevant market, where the bet was placed in breach of these Terms or applicable law, or where the bet is affected by an integrity matter that requires the bet to be voided. Where a bet is voided, the stake is returned at decimal odds of 1.00. For multi bets, a voided leg is removed and the remaining legs continue to apply.
10. Settlement rules
Bets are settled on the basis of the official result published by the recognised governing body of the relevant sport or racing authority. Where two recognised authorities publish different results, the rules of the specific market determine which source applies. Where a result is later changed by the governing body or racing authority, settlement may be revised in accordance with the rules of the specific market.
Dead heats are settled by dividing the stake by the number of runners or competitors involved in the dead heat. Disqualifications, scratchings and protests are settled per the rules of the relevant market. Abandoned events are settled per the rules of the relevant market or, where the rules do not address the situation, the bet is voided. Cash Out, where offered pre-event, is a presentational tool and not a contractual right. We may withdraw it at any time.
11. Multi bets and Same Game Multis
Multi bets settle leg by leg. A void leg reduces the multi by that selection's odds, and remaining legs continue to apply. Same Game Multis combine selections within a single event and are priced on dependent outcomes. The price displayed at confirmation reflects the leg correlation reduction applied at that time. Where a Same Game Multi leg is voided, the multi is re-priced or settled in accordance with the rules of the specific market.
Maximum payouts may apply to multi bets and Same Game Multis. Where a maximum payout applies, it is disclosed with the market at the time of bet placement and on the settled bet record.
12. Limits
We may apply per-customer, per-market, per-event or per-period limits at our reasonable discretion, including for responsible gambling, risk, integrity, compliance or commercial reasons. Limits applied for responsible gambling reasons take account of customer-set deposit limits, indicators of harm, and customer interaction outcomes under our responsible gambling program.
We will tell you about any limit that affects your Account in a clear and timely way, unless we are prevented by law from doing so (for example, where a tipping-off restriction applies under the AML/CTF Act).
13. Account closure
You may close your Account at any time by contacting support@bookiepnice.com from your verified email address. We may close your Account where required by law or regulator request, where required for AML/CTF reasons, where we reasonably suspect a breach of these Terms, fraud, collusion or integrity offences, or where we are no longer able to provide the Service to you for commercial or compliance reasons.
On Account closure, any cleared balance is returned to your verified bank account or PayID, subject to identity, payment and AML/CTF checks. Open bets are settled in accordance with their market rules. Account closure does not automatically self-exclude you. If you would like to self-exclude, see our self-exclusion guide.
14. Dormant accounts
If your Account has had no customer-initiated activity for 13 months, we will treat the Account as dormant. We will send a notice to your verified email address before any further action is taken. Where required by law, unclaimed funds may be remitted to the relevant unclaimed-money authority, including under the Unclaimed Money Act 1995 (NSW). You may claim returned funds from the relevant authority in accordance with that authority's published procedures.
15. Promotional credits
Each promotion has its own terms, which appear with the offer and are the controlling terms for that promotion. Promotions are available only to eligible verified customers and may be limited by customer location, account status, product type, market, event, minimum odds, stake amount, time period or other stated conditions. Bonus bets must be staked in full, cannot be withdrawn as cash, cannot be split unless the promotion terms state otherwise, and the bonus stake is not returned with any winnings. Promotions may be amended, suspended or withdrawn where permitted by law and by the relevant promotion terms.
Responsible gambling controls, account restrictions, self-exclusion, verification checks and payment checks may affect eligibility for promotions. We do not promote sign-up inducements where they are prohibited under State or Territory law, including in New South Wales under section 15A of the Betting and Racing Act 1998 (NSW).
16. Responsible gambling
We participate in the National Consumer Protection Framework for Online Wagering. You can set deposit limits, take a break, or self-exclude at any time from your Account. We do not send marketing to customers who have opted out, who are self-excluded, or who are in a pre-commitment cool-off period. 17. Privacy
Our handling of personal information is set out in our Privacy Policy. We collect, hold, use and disclose personal information in accordance with the Privacy Act and the thirteen Australian Privacy Principles. You may make a privacy request by emailing privacy@bookiepnice.com.
18. Marketing communications
Where you have opted in, we may send promotional emails, SMS and push notifications about wagering products. You can opt out at any time using the unsubscribe link or your account settings. We do not send marketing to customers who are self-excluded, who have asked us to stop, who are within a 7-day deposit-limit cool-off, or who opened an Account within the last 24 hours.
19. Errors, omissions and technical failure
We use reasonable steps to make the Service available, but we do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, technical failure, network or infrastructure issues, third-party feed outages, or events outside our reasonable control. Where the Service is unavailable in a way that affects bet placement or settlement, affected bets are handled in accordance with the rules of the relevant market.
Where a clerical, transmission or system error results in a price, line, total or selection being offered or accepted in a way that was not intended by us, we may void affected bets and return the stake. We will not be liable for losses arising from such errors beyond the return of the stake, subject to the Australian Consumer Law.
20. Disputes and complaints
If you have a complaint, contact complaints@bookiepnice.com. We acknowledge complaints within 2 business days of receipt and aim to resolve them within 21 calendar days, or 45 calendar days for complex matters. If you remain unsatisfied with the outcome, you may escalate as set out in our complaints policy, including to Liquor & Gaming NSW for wagering disputes.
21. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Where a consumer guarantee applies and cannot be excluded, our liability for breach of that guarantee is limited to the extent permitted by law to the supplying of the services again or the payment of the cost of having the services supplied again.
To the extent permitted by law, our liability for any other loss, damage, cost or expense arising out of or in connection with the Service is limited to the amount of the bet in dispute. We are not liable for indirect, consequential or special loss, including loss of profits, loss of business opportunity or loss of goodwill, except to the extent that limitation is not permitted by law.
22. Changes to these terms
We may amend these Terms by posting the updated version on this page. Where a change is material, we will notify you by email and by an in-product banner at least 14 days before the change takes effect, unless a shorter notice period is required by law, by regulator request, or to address a security, fraud, integrity or compliance issue. If you do not accept the change, you may close your Account before the change takes effect. If you continue to use the Service after a change takes effect, you accept the new Terms.
23. Severability, entire agreement and waiver
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, legal and enforceable, or, if modification is not possible, severed from these Terms. The remaining provisions will continue in full force and effect.
These Terms, together with the documents incorporated by reference (including market rules and promotion terms), set out the entire agreement between you and us about the Service. A failure or delay by us in exercising any right under these Terms is not a waiver of that right. A waiver is effective only if given in writing and signed by an authorised representative of BookiePrice Pty Ltd.
24. Notices and governing law
We may give you notices by email to your verified email address, by in-product message, or by post to your registered address. You may give us notices by email to support@bookiepnice.com or by post to BookiePrice Pty Ltd, Level 3, 91 Phillip Street, Parramatta NSW 2150, Australia. A notice is taken to be received when it has been delivered in the ordinary course of the chosen method.
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales. Nothing in this section affects any right you have under the Australian Consumer Law or other consumer protection legislation that cannot be excluded.
